Changing the ADA... The DOJ recently published draft regulations that will affect Title II of the ADA. Title II governs government facilities and programs (including public schools). There is evidently some question in the minds of some in government whether dogs used by the developmentally disabled qualify as assistance dogs, or if they are only "comfort" or "therapy" dogs, and they are accepting comments from the public until August 18, 2008.As you probably already know, Title III of the ADA requires private businesses (such as restaurants, stores, hotels, etc.) to allow assistance animals, and it also defines an assistance animal as any animal that has been individually trained to perform one or more tasks for the benefit of the disabled. Autism assistance animals fit this definition. In addition to the therapy functions for which such an animal is trained, they are also trained in much the same way as a seeing eye dog. They
